Welcome to Danube Choice (operated by Danube Choice Kft.). By accessing or using our website danubechoice.eu (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
1. Definitions
- "We", "us", "our" — Danube Choice Kft., a company registered in Hungary.
- "You", "user", "customer" — any individual who visits or purchases from our website.
- "Products" — items offered for sale on our website.
- "Order" — a request by you to purchase Products.
2. Eligibility
To place an order, you must be at least 16 years old and legally capable of entering into binding contracts under Hungarian law. If you are under 18, you confirm that your legal guardian has reviewed and approved your order.
3. Account
You may create an account to track orders and save preferences. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@danubechoice.eu of any unauthorized use.
4. Orders & Contracts
- Placing an order constitutes an offer to purchase. The contract is formed only when we send you an order confirmation email accepting your offer.
- We reserve the right to refuse or cancel any order, including in cases of pricing errors, suspected fraud, or product unavailability. In such cases, you will receive a full refund.
- All prices are shown in Hungarian Forint (HUF / Ft) and include Hungarian VAT (27%) where applicable.
5. Pricing & Payment
- Prices are listed on each product page and are valid at the time of ordering.
- We accept Visa, Mastercard, Apple Pay, Google Pay, Barion, and PayPal via secure, PCI-DSS compliant gateways.
- Payment is authorized at checkout and charged when the order is dispatched.
- If payment cannot be processed, your order may be cancelled.
6. Product Information
We make every effort to display product descriptions, images, and prices accurately. However, we do not warrant that product information is entirely error-free. Colors and dimensions may vary slightly from what appears on your screen. If you receive a product that does not match its description, you may invoke your right of withdrawal under our Returns & Refunds Policy.
7. Warranty
All products sold are covered by the 2-year statutory warranty required by Hungarian Civil Code and EU Directive 2019/771. Manufacturer warranties may also apply. For warranty claims, contact support@danubechoice.eu with proof of purchase.
8. Right of Withdrawal
As an EU consumer, you have the right to withdraw from a distance contract within 14 days without giving any reason. See our Returns & Refunds Policy for full details and the withdrawal form.
9. Intellectual Property
All content on this website — including text, graphics, logos, images, and software — is the property of Danube Choice Kft. or its licensors and is protected by Hungarian and EU copyright law. You may not reproduce, distribute, or modify any content without our prior written consent.
10. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to gain unauthorized access to our systems or data.
- Use bots, scrapers, or automated tools to extract data.
- Place fraudulent orders or abuse the return policy.
- Post false, misleading, or harmful reviews.
11. Limitation of Liability
To the maximum extent permitted by law, Danube Choice Kft. shall not be liable for indirect, incidental, or consequential damages arising from the use of the Service. Our total liability for any claim shall not exceed the amount you paid for the product(s) giving rise to the claim. This does not affect your statutory rights as a consumer under Hungarian and EU law.
12. Indemnification
You agree to indemnify and hold Danube Choice Kft. harmless from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the Service.
13. Governing Law & Dispute Resolution
- These Terms are governed by the laws of Hungary, without regard to conflict-of-law rules.
- The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
- Consumers may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
- The competent courts of Budapest, Hungary, have jurisdiction over disputes that cannot be resolved amicably.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date reflects the latest version. Continued use of the Service after changes constitutes acceptance of the revised Terms.
